He claims the casino allowed him to gamble while incapacitated and failed to provide explanations for the markers. Though the fraud charges were dismissed after he agreed to pay restitution, Thomson is now seeking to invalidate the markers, damages exceeding $75,000, and a jury trial, alleging negligence, unfair trade practices, and malicious prosecution. He asserts that Aria violated Nevada gaming regulations by allowing a visibly impaired patron to gamble. MGM Resorts has not yet responded to the lawsuit.
