Supreme Federal Court sets date for Brazil online gambling hearing
Summary
Brazil's Supreme Federal Court (STF) has confirmed it will hold a public hearing on Tuesday 3 November at 10:00 am local time to discuss the impact of Provisional Measure (MP) 1.394/2026, which was issued by President Luiz Inácio Lula da Silva on 25 September to ban all online gambling, including online casino and sports betting. The hearing was scheduled within the scope of a Direct Action of Unconstitutionality (ADI) 8027, filed by the National Association of Games and Lotteries (ANJL), which is challenging the provisional measure as unconstitutional and seeks its immediate suspension and a formal declaration of unconstitutionality, while also requesting that the STF affirm the constitutionality of the laws that currently regulate online sports betting and gaming in the country. The Office of the Attorney General (AGU) had also requested an assessment regarding the possibility of holding a new public hearing, arguing that the experience gained since the previous hearing held in November 2024, along with new evidence concerning the impact of betting and the issuance of the provisional measure, justifies an updated debate. The hearing will include participation from 26 institutions and entities, including the ANJL, the Brazilian Institute for Responsible Gaming (IBJR), the National Confederation of Trade in Goods, Services, and Tourism (CNC), the National Confederation of Industry (CNI), the Ministry of Finance, and the AGU, as well as representatives from several Brazilian football clubs including Flamengo, Fluminense, Botafogo, Cruzeiro, São Paulo, Corinthians, Ponte Preta, Vitória, Guarani, and Portuguesa, and the Brazilian Football Confederation (CBF). In related news, President Lula was re-elected to a fourth non-consecutive term in Sunday's general election, while the whereabouts of defeated presidential candidate Flávio Bolsonaro is unknown after Brazil cancelled his passports following an investigation into alleged money laundering with ties to online gambling.
